Mark Heath - Probate Judge
Judge Mark Heath was born in the small farming community of Rockfish, North Carolina. After graduating from Hoke County Public Schools, Judge Heath attended Appalachian State University where he received a Bachelor of Arts in Sociology with a minor in Psychology upon graduation in 1975.
Upon moving to Marlboro County, Judge Heath was employed with Probation, Parole and Pardons for over twenty-three years until he took office January 4, 1999 as Probate Judge of Marlboro County.
The Probate Court has original jurisdiction over actions concerning the issuance of marriage licenses, the estate of deceased persons, the will of an individual, the estate of a minor or incapacitated person, trusts, and involuntary commitments.
Most probate matters are handled without a jury trial, but Probate Court does have the authority to conduct a jury trial. If there is a "Will" this must be filed with the court within thirty days from the date of death. Judge Heath also presides over the Drug Court in Marlboro County.
